Communications and Documentation: Best Practices for Managing Professional Liability
3 AIA LU | 2 HSW learning units will be reported to AIA for all AIA members attending. We believe the program will also be eligible for 3 PDUs in health, safety and welfare toward Kentucky state licensing requirements. Individuals are responsible for reporting credits to the Kentucky Board of Architects. AIA Kentucky will provide attendance verification forms to all attendees at the conclusion of the program.
This program is two-fold, with the first portion of the presentation focusing on the dos and donâts of email correspondence, which is part of the oxygen of our daily professional lives. Given the litigious nature of our world, it is critical to treat this common form of communication with the attention it needs and think very carefully about what we write and why we write it. This program presents examples of self-implicating and subsequently weaponized emails plus guidelines for writing appropriate, shorter, clearer messages.
The second portion of the program will closely review a case study involving the value-engineering of a new schoolâs foundation, and the subsequent damage to plumbing pipes buried in highly expansive native soil. The presenter will review key points of the claim and present a summary of the actual settlement or judgment. Participants will learn what may have contributed to or exacerbated the situation, and they will discuss actions that could have been taken to eliminate, reduce or mitigate contributing factors.
LEARNING OBJECTIVES:
- Recognize the litigious nature of todayâs businesses and the importance of carefully managing communications.
- Identify seven litmus test questions to evaluate emails before sending them; and to access the need to send or further revise an email message with four recommended preemptive actions.
- Participants will analyze how the failure to communicate and document concerns about project issues can lead to increased risk of the health, safety and welfare of students and increase the design professionalâs risk.
- Discuss the appropriate course of action to address and rectify the red flags encountered in the case study above and other similar scenarios in terms of short-term and long-term safety and risk management.
